Payment terms will be agreed and confirmed at quote stage. Depending on the size and nature of the project, this will typically be one of the following structures:
Any change to the agreed scope of works — including additions, alterations, or omissions — must be agreed in writing before being carried out.
All variations will be priced and issued as a written variation order. Works will not proceed on a variation until the client has confirmed acceptance in writing.
Vantage Landscaping Ltd accepts no liability for delays or cost increases caused by client-requested variations mid-project.
The client is responsible for ensuring clear and safe access to the site at all agreed working times. Delays or additional costs arising from restricted or unavailable access are the client’s responsibility and will be chargeable.
The client must ensure that all necessary permissions, permits, and consents are obtained prior to works commencing. This includes but is not limited to planning permission, permitted development rights, highway permits for skips or plant, and any party wall agreements.
Prior to any ground works commencing, the client is responsible for providing accurate plans of all underground services including gas, water, electricity, telecommunications, and drainage.
Where no plans are available, the client is responsible for arranging a CAT (Cable Avoidance Tool) scan prior to works starting. Vantage Landscaping Ltd can arrange this on the client’s behalf and the cost will be added to the invoice.
Vantage Landscaping Ltd accepts no liability whatsoever for damage to any underground service, cable, pipe, or infrastructure that is incorrectly marked, not marked at all, or not laid at the correct depth in accordance with current industry standards.
Where works require access across existing driveways, paths, or surfaces, Vantage Landscaping Ltd will take reasonable steps to protect those surfaces using plywood, hardboard, or other appropriate materials.
The cost of surface protection will either be included in the quote or added as a chargeable item depending on the scope and nature of the works. This will be confirmed at quote stage.
Vantage Landscaping Ltd will not be held liable for incidental damage to surfaces that were not disclosed prior to works commencing, or that were in a pre-existing poor or weakened condition.
All plant and equipment brought onto site by Vantage Landscaping Ltd remains our property and responsibility throughout the duration of the works.
The client must not operate, move, adjust, or interfere with any plant or equipment on site under any circumstances.
The client is responsible for the reasonable security of the site outside of working hours. Vantage Landscaping Ltd accepts no liability for theft, vandalism, or damage to materials or equipment left on site overnight, unless directly caused by our negligence.
The client is expected to provide reasonable access to mains electricity and water supply for the duration of the works. If this is not possible or is refused, the cost of alternative supply (including generator hire and water bowser) will be added to the invoice.
The client is expected to allow operative use of toilet facilities on site during working hours. If access is refused or no suitable facilities are available, the cost of portable toilet hire will be added to the invoice.
Where materials are supplied by Vantage Landscaping Ltd, we will ensure they are fit for purpose and consistent with the specification in the quote.
Where the client supplies their own materials, Vantage Landscaping Ltd accepts no liability for the failure, damage, or breakage of those materials during or after installation. Any remedial work required as a result of substandard, incorrect, or unsuitable client-supplied materials will be charged as a variation.
Living materials including turf, plants, shrubs, and trees are guaranteed up to the point of handover only. The client is fully responsible for watering, feeding, and general aftercare following completion. Vantage Landscaping Ltd accepts no liability for the failure of living materials after handover.
Newly laid concrete, resin, block paving, and similar surfaces require a curing period before they can be used or loaded. Vantage Landscaping Ltd will advise the client of the required curing period at the point of handover.
The client must keep all persons, vehicles, and heavy loads clear of newly laid surfaces for the full curing period advised. Vantage Landscaping Ltd accepts no liability for damage caused by failure to observe curing instructions.
The client is responsible for notifying and managing relationships with neighbouring properties prior to and during works.
Vantage Landscaping Ltd accepts no liability for complaints, disputes, or claims arising from neighbouring properties, including but not limited to noise, dust, boundary disputes, or party wall matters.
Any costs arising from disputes with neighbouring parties remain the sole responsibility of the client.
Standard working hours are Monday to Friday 8:00am–5:00pm, and Saturday 9:00am to a reasonable finish.
Sunday and Bank Holiday working is entirely at Vantage Landscaping Ltd’s discretion and may be subject to a surcharge, which will be agreed with the client in advance.
Vantage Landscaping Ltd accepts no liability for noise complaints arising from works carried out within the above standard working hours.
Vantage Landscaping Ltd may engage subcontractors to carry out all or part of the works. The quality and standard of all works remains the responsibility of Vantage Landscaping Ltd regardless of who carries them out.
Any concerns or defects must be raised directly with Vantage Landscaping Ltd promptly, and wherever possible before works are formally signed off at completion.
Vantage Landscaping Ltd must be given a fair and reasonable opportunity to return to site and remedy any identified defect before any third party is instructed to carry out remedial works.
If the client instructs a third party to carry out remedial works without first allowing Vantage Landscaping Ltd the opportunity to remedy, we will accept no liability for the cost of those third-party works or any further damage caused as a result.
Raising a complaint does not entitle the client to withhold payment unless this has been formally agreed in writing by both parties.
Upon completion of works, the client will be invited to carry out a walkround with the site operative or project manager to inspect the finished works.
Signing off on completion confirms the client’s satisfaction with the works as completed. Any snagging items identified during the walkround will be documented and agreed at that point.
Once works are formally signed off, no further snagging claims will be accepted except where a defect could not reasonably have been identified at the time of sign-off.
Vantage Landscaping Ltd reserves the right to photograph and film works at any stage — including before, during, and after completion — for use in marketing, social media, and portfolio purposes.
No personally identifying information (including full address) will be published alongside imagery without the client’s explicit consent.
Vantage Landscaping Ltd’s total liability to the client shall not exceed the total contract value under which the claim arises.
We accept no liability for indirect or consequential losses including loss of use, loss of enjoyment, or loss of income.
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
